CAB Advisory Bulletin: Quarterly Report Deadline


April 5, 2012: CAB Quarterly Reporting Guidelines

The web portal that allows for submitting credit access business (CAB) quarterly reports is now available and data reporting is currently ongoing.  Each CAB is encouraged to create user accounts and to become familiar with CAB reporting requirements before submitting data. CABs with multiple locations must report data on each individual location.

April 2, 2012: CAB Quarterly and Annual Reporting

In accordance with Section 393.627 of the Texas Finance Code, all credit access businesses are required to submit data reports related to the extensions of credit. First quarter reporting is now ongoing and must be submitted by April 30, 2012. Reporting data can be entered by following the link above. Annual Report forms and acompanying instructions are now available for Property Tax Lenders and Regulated Lenders. These forms are within under the "Credit Industry Services" section of the agency's website. You may access this section by clicking here or by selecting the Credit Industry Services tab at the top of this page.

Property Tax Lenders must submit annual reports by March 31, 2012
Regulated Lenders must submit annual reports by May 1, 2012

Crafted Precious Metal Dealer: Weights & Measures Program

The Texas Department of Agriculture (TDA) requires that all commercially used weighing or measuring devices be registered, including those used by crafted precious metal dealers. Visit the TDA's Weights and Measures Program for more information.

Crafted Precious Metal Dealer Registration (CPMD) Site Now Available

Effective January 1, 2012, all Crafted Precious Metal Dealers are required to register with the Office of Consumer Credit Commissioner (OCCC). Registration application links are now available through the OCCC website. The links can be accessed by clicking here, or by selecting "Credit Industry Services" above and then locating the Crafted Precious Metal Dealer section.

Note: All CPMD registrations are completed and submitted through the Texas Department of Public Safety (TxDPS) Precious Metals portal. After selecting the appropriate registration link, you will be redirected to the TxDPS Precious Metals portal. Ensure you do not register through the Metals Recycling program/portal on the TxDPS site.

Consumer Disclosure Forms - Credit Access Businesses

The OCCC needs your help!

Consumers looking to borrow money through payday loans are given various disclosures containing the basic facts about the loan they've applied for. We want your feedback and help in designing a simple dislcosure that tells of the potential costs of payday loans, how long it may take to repay a loan, and how costs of other borrowing options may compare those of payday loans.

Credit Access Business (CAB) License Applications Available

Application forms for Credit Access Business Licenses are now available through the OCCC website. The forms can be accessed by clicking here, or by selecting "Credit Industry Services" above and then locating the Credit Access Business section. Applications may be submitted electronically via email, or may be printed and submitted via postal or delivery service.

Instructions and a checklist are provided, which outline the steps to be taken for either electronic or postal and delivery service submissions. If applications are submitted electronically, a signed consent form and payment must be received within ten (10) of submission or the application will not be accepted.

Motor Vehicle Dealer Education

The first of several self-paced learning modules for motor vehicle dealers is now available through the OCCC's website.

Learn which dealers are required to obtain a motor vehicle sales finance license under Chapter 348; discover what is considered to be a retail installment contract; and learn the defintion of a motor vehicle as it relates to retail installment contracts. The learning module is provided in both a movie format and as a PDF file, and can be completed in ten to fifteen minutes.

Notice of  Pawnshop Rule Change

As required by Texas Finance Code, §371.006, the Office of Consumer Credit Commissioner is notifying pawnshops of rule amendments affecting pawnshop operations adopted by the Finance Commission of Texas at its meeting on April 15, 2011. These amendments to §85.402, concerning Recordkeeping, are to be effective on June 6, 2011.

Time for motor vehicle sales finance renewal.

As indicated within the renewal packet the assessment fees have been adjusted as authorized by 7 TAC §84.611. These fee changes were adopted by the Finance Commission at the February 19, 2010 meeting. Prior to the adoption the agency held stakeholder meetings and asked for pre-comment on the proposed changes. Additionally, comments regarding the proposed changes were submitted during the official comment period as required by Texas Government Code §2001.023. All comments were considered prior to the rule’s final adoption. As part of the comments submitted, it was suggested, if possible, that the first year assessment be reduced. The agency reviewed its revenue and expenditure levels and agreed; thereby providing a 20% discount on this year’s assessment fee.

MOTOR VEHICLE RENEWALS

Motor Vehicle Sales Finance License renewals will be mailed by the middle of June.  This mailing will contain the only renewal forms you will receive this year.  Motor Vehicle Sales Finance License renewals are due July 1st, but there is a grace period until July 31st.

The 2008 Annual Report for Regulated Loan Licensees and Property Tax Licensees are due in our office by May 1, 2009.  If you do not have a copy of the form, a printable copy is available for the Regulated Lender Annual Report as well as the Property Tax Lender Annual Report, Property Tax Lender instructions.

Delinquency notices for motor vehicle renewals have been mailed. Any license renewal not postmarked by the United State's Post Ofiice or by an overnight courier by July 31, 2008, will expire. In order to reinstate an expired license, the law requires payment of an additional $1,000.
